Age discrimination applies to individuals who are 40 years of age or older and employed by an employer who has twenty (20) or more employees. The Age Discrimination in Employment Act of 1967 commonly referred to as ADEA protects individuals in this category. The ADEA's protections apply to both employees and job applicants. Under the ADEA, it is unlawful to discriminate against a person because of his/her age with respect to any term, condition, or privilege of employment, including hiring, firing, promotion, layoff, compensation, benefits, job assignments, and training. It is also unlawful to retaliate against an employee for disagreeing with a discriminatory practice related to age in the work place and or, cooperating in an investigation, proceeding, or litigation related to ADEA. The ADEA protects all qualified individuals in the private sector, local government, state government and federal government. In addition, The Older Workers Benefit Protection Act of 1990 amended the ADEA to prohibit discrimination related to the cost of health benefits for older employees.
