A Separation Agreement:
This is an uncontested agreement that is filed in the County Clerks Office pursuant to the NYS Domestic Relations Law. After one (1) year of separation, grounds for a divorce have been established and the respective court will grant a divorce.
Cruel & Inhuman Treatment:
This is either contested or uncontested and establishes immediate grounds for a divorce.
Abandonment:
This is also immediate grounds for a divorce, however, you must prove your argument.
Annulment:
Generally, you must prove fraud to be granted an annulment by the court.
A NO-FAULT State:
This is either a contested or uncontested divorce based on irreconcilable differences and the respective court will hear each argument and grant and immediate divorce.
Private Detective:
Regardless of the state, generally the court does not care or choose to hear about infidelity. The hiring of a private detective in this case is simply your prerogative and right to know. An uncontested divorce is the most affordable divorce, in that, attorney’s fees are minimal, and the professional services of a private detective are not required. On the other hand, a private detective is essential when the individuals involved don’t agree; the divorce is contested, or in cases of mitigating circumstances. This may include establishing a sold foundation for your attorney or locating hidden assets. In essence, a private detective is a team player working together with both you and your attorney to protect and identify your legal interest.
